War Militaria is an e-commerce website dedicated to the sale of collectible items, reproductions, historical objects, accessories and products connected with military history.

The products, historical references, images, descriptions and contents displayed on the website are published exclusively for historical, collecting, documentary, cultural, educational and study purposes.

The presence of items, symbols, uniforms, decorations, references or reproductions connected with historical events, including the First and Second World Wars, does not constitute in any way approval, promotion, propaganda, endorsement or glorification of ideologies, movements, regimes, political, military or paramilitary organisations, past or present.

War Militaria does not support, promote or finance any political, ideological, extremist, racist, discriminatory, violent or intolerant group.

WMB International S.R.L. Unipersonale is a modern and inclusive company that rejects all forms of hatred, racism, discrimination, intolerance, antisemitism, xenophobia, political violence or glorification of totalitarian ideologies.

The user undertakes not to use the purchased products, images, contents or information available on the website for unlawful, propagandistic, discriminatory, violent, defamatory or illegal purposes.

General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern access to, browsing and use of the website https://www.warmilitaria.it/, as well as the purchase of products offered through the website.

Use of the website and submission of an order imply acceptance of these Terms and Conditions, the Privacy Policy, the Cookie Policy and any other notices made available on the website.

2. Definitions

For the purposes of these Terms and Conditions:

Seller: WMB International S.R.L. Unipersonale.

Website: https://www.warmilitaria.it/ and its pages, sections and functions.

Products: collectible items, reproductions, accessories and other goods offered for sale through the website.

User: any person who accesses, browses or uses the website.

Customer: any person who makes a purchase through the website.

Consumer: a natural person acting for purposes unrelated to any business, commercial, craft or professional activity.

Professional / Non-consumer customer: any person or entity purchasing within the scope of a business, commercial, craft or professional activity, including through a VAT number.

Terms: these General Terms and Conditions of Sale.

3. Scope of application

These Terms apply to all orders placed through the website.

Before confirming the order, the Customer is invited to carefully read these Terms, the Returns Policy, the Privacy Policy and any other information available on the website.

The Seller may amend or update these Terms at any time. Amendments shall apply only to orders placed after the updated version has been published on the website.

4. Registration and account

Some website functions may require the creation of an account.

The Customer undertakes to provide true, complete, up-to-date and correct data. The Customer is responsible for keeping login credentials secure and for all activities carried out through the account.

The Seller shall not be liable for unauthorised use of the account resulting from loss, disclosure, theft or failure to safeguard credentials by the Customer.

The Customer may request deletion of the account by writing to info@warmilitaria.it. The Seller’s statutory, tax, accounting and legal retention obligations remain unaffected.

The Seller reserves the right to suspend or close an account in case of breach of these Terms, unlawful use of the website, fraud, abuse, unlawful conduct or prejudice to the Seller or third parties.

5. Products, descriptions and purpose of the items

The Seller undertakes to describe and represent the products as accurately as possible.

Images published on the website are for illustrative purposes. Minor differences may exist between images, colours, dimensions, finishes and the product actually received, including due to screen settings, photographic lighting, production methods or the handmade or decorative nature of certain items.

Many products are reproductions, collectible items, decorative objects or items with intentionally aged, oxidised, worn or antique-style finishes. Scratches, stains, oxidation, colour variations, wear marks or other intentional aesthetic features shall not constitute defects where they form part of the description, finish, nature or appearance of the product.

Before purchasing, the Customer must check the product description, photographs, dimensions, characteristics and all information available on the product page.

6. Product availability

Product availability shown on the website is updated regularly. However, due to simultaneous sales, technical errors or inventory discrepancies, an ordered product may be unavailable.

In case of total or partial unavailability, the Seller will inform the Customer and may offer:

• waiting for restock, where possible;
• replacement with another product;
• total or partial refund of the amount paid;
• total or partial cancellation of the order.

The contract shall be deemed concluded only for the products actually available and confirmed.

7. Conclusion of the contract

The sales contract is concluded when the Customer submits the order through the website and the Seller confirms receipt of the order by confirmation email or summary page.

Before submitting the order, the Customer may check and correct any errors in the data entered.

The order confirmation contains, directly or through links to the website pages, the main purchase information, including Seller details, purchased products, price, applicable taxes, shipping costs, payment method, delivery address and information on withdrawal, returns and legal guarantee.

The Seller reserves the right to refuse or cancel an order in the following cases:

• product unavailable;
• payment not authorised or not completed;
• incomplete, incorrect or unverifiable Customer data;
• suspicion of fraud, abuse or unlawful activity;
• clearly incorrect price recognisable as an error;
• destination not served or subject to logistical, customs or legal restrictions;
• breach of these Terms.

If an already paid order is cancelled, the Seller will refund the amount received.

8. Prices, taxes and shipping costs

All prices are indicated in euros and include VAT where due.

Shipping costs, taxes, additional costs or surcharges are indicated before order confirmation, except for costs that cannot be calculated in advance, such as customs duties, import taxes or import costs for shipments to non-EU countries.

The Seller may change prices and shipping costs at any time. Changes do not apply to orders already confirmed.

In case of a clearly incorrect price, the Seller may cancel the order and refund any amount paid.

9. Payment methods

Available payment methods may include, by way of example:

• PayPal;
• debit and credit cards;
• bank transfer, where available;
• iDEAL, where available;
• cash on delivery, where available and only for certain destinations;
• PostePay or other local payment methods, where available;
• other payment systems offered by the gateways active at checkout.

The payment methods actually available are shown during the order process.

The website uses third-party payment services. The Seller does not process or store full payment card data or credentials of the payment systems used by the Customer.

The Seller is not responsible for delays, refusals or failure to authorise payment attributable to the payment service provider or the Customer’s institution.

10. Invoicing

For Customers purchasing with a VAT number, the invoice is issued based on the data provided by the Customer.

The Customer is responsible for the accuracy, completeness and truthfulness of the tax data provided.

Any requests to amend invoicing data must be communicated promptly and may be accepted only within the limits permitted by applicable tax law.

11. Shipping and delivery

Products are delivered to the address indicated by the Customer during the order process.

Delivery methods, costs and estimated delivery times are indicated before order confirmation or on the relevant information page.

Shipments may be made through national or international couriers, including BRT, DPD, FedEx or other logistics operators.

Delivery times are indicative unless expressly agreed otherwise. Delays due to couriers, customs, holidays, exceptional events, force majeure or incorrect information provided by the Customer are not attributable to the Seller, within the limits permitted by law.

The Customer must provide a complete and correct address. Costs resulting from incorrect addresses, storage, failure to collect, redelivery or return to sender may be charged to the Customer, unless attributable to the Seller.

12. Checking the parcel upon delivery

Upon delivery, the Customer is invited to check:

• integrity of the packaging;
• absence of visible tampering;
• number of parcels;
• any obvious damage.

In case of a damaged, opened, wet, tampered or visibly compromised parcel, the Customer is invited, where possible, to accept with specific reservation or refuse delivery and promptly inform the Seller.

The Customer is invited to document any damage with photographs of the external packaging, internal packaging and product.

This provision does not limit the Consumer’s rights regarding legal guarantee and non-conforming products.

13. Non-EU shipments, customs, duties and import

For shipments to countries outside the European Union, the Customer is responsible for any customs duties, import taxes, clearance charges, administrative costs or other amounts requested by the competent authorities of the destination country.

These costs are not included in the product price or shipping costs, unless expressly stated otherwise.

The Customer is also responsible for checking any restrictions, prohibitions, customs requirements or local regulations applicable to the import of the purchased products.

The Seller shall not be liable for delays, customs holds, seizures, additional costs, failed delivery or return to sender resulting from regulations, procedures or decisions of the authorities of the destination country, unless liability is attributable to the Seller.

14. Right of withdrawal and returns policy

The Consumer has the right to withdraw from the contract in the cases and within the time limits provided by Articles 52 et seq. of the Italian Consumer Code.

War Militaria grants Consumer Customers a more favourable commercial period, allowing return requests within 30 days from receipt of the order, subject to the exceptions and conditions set out in the Returns Policy.

A Customer who wishes to withdraw or request a return must follow the instructions provided in the Returns Policypage, which forms an integral part of these Terms.

In case of withdrawal by the Consumer, the refund will be made according to the methods and time limits provided by applicable law and the Returns Policy.

The direct cost of returning conforming products shall be borne by the Customer, unless otherwise expressly stated or agreed.

The Customer is responsible for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

15. Exceptions to the right of withdrawal

The right of withdrawal may be excluded or limited in the cases provided by Article 59 of the Italian Consumer Code and applicable law.

Unless otherwise stated, withdrawal may be excluded for:

• products made to the Customer’s specifications or clearly personalised;
• sealed products that are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery;
• products which, after delivery, are inseparably mixed with other goods;
• products that have been used, altered, damaged or are no longer suitable for resale, unless the issue is due to a lack of conformity.

These exclusions do not affect the Consumer’s rights in case of defective, incorrect, damaged upon delivery or non-conforming products.

16. Legal guarantee of conformity

Products sold to Consumers are covered by the legal guarantee of conformity provided by Articles 128 et seq. of the Italian Consumer Code.

The Seller is liable towards the Consumer for any lack of conformity existing at the time of delivery of the goods and appearing within the time limits provided by applicable law.

In case of lack of conformity, the Consumer is entitled to the remedies provided by law, including, according to the conditions and order established by the applicable legislation:

• restoration of conformity;
• repair;
• replacement;
• proportional price reduction;
• termination of the contract and refund, where provided by law.

The remedies under the legal guarantee must be provided free of charge for the Consumer, within the limits set by applicable law.

A Consumer who believes they have received a defective or non-conforming product must contact the Seller at info@warmilitaria.it, attaching the order number, description of the issue and photographs of the product and packaging.

For non-consumer Customers, the warranties provided by the Italian Civil Code apply within the limits and time limits set out therein.

17. Product safety

The Seller operates in compliance with applicable product safety legislation, including, where applicable, Regulation (EU) 2023/988 and national implementing or coordination rules.

The Customer must use the products in accordance with their intended purpose, any instructions provided and normal rules of prudence.

Collectible, decorative or historical products must not be used for improper, dangerous, unlawful or unforeseeable purposes.

18. Lawful use of the website and products

The User undertakes to use the website lawfully, correctly and in accordance with these Terms.

It is prohibited to use the website, contents or products for:

• illegal, fraudulent or abusive purposes;
• extremist, racist, discriminatory or violent political propaganda;
• promotion of hatred, violence or totalitarian ideologies;
• infringement of third-party rights;
• activities that may damage the website, the Seller or other users;
• unauthorised resale of website contents, images or materials.

The Seller reserves the right to refuse orders, suspend accounts or report conduct to the competent authorities in case of unlawful or abusive use.

19. Intellectual property

All website contents, including texts, images, photographs, logos, graphics, trademarks, descriptions, product sheets, layouts and digital materials, are owned by the Seller or their respective owners/licensors.

Any unauthorised reproduction, copying, distribution, modification, publication, extraction, reuse or exploitation of website contents is prohibited unless prior written authorisation is granted by the Seller.

Purchase of a product does not transfer any intellectual property rights in the website contents.

20. Reviews, user-generated content and communications

Where the website allows users to submit reviews, comments, photographs or other content, the user guarantees that such content is truthful, lawful, non-defamatory, non-offensive and does not infringe third-party rights.

The Seller reserves the right not to publish or to remove unlawful, offensive, discriminatory, misleading, irrelevant, promotional or non-compliant content.

Any reviews published must comply with applicable rules on transparency, unfair commercial practices and consumer protection.

21. Privacy and personal data protection

Personal data is processed in accordance with Regulation (EU) 2016/679, Italian Legislative Decree 196/2003 as amended, and the Privacy Policy available on the website.

22. Limitation of liability

To the extent permitted by law, the Seller shall not be liable for indirect damages, loss of profit, loss of business opportunity, loss of data, reputational damage or other losses not directly resulting from a breach attributable to the Seller.

No provision of these Terms limits or excludes the Seller’s liability where such limitation or exclusion is not permitted by law, including mandatory Consumer rights, the legal guarantee of conformity, wilful misconduct or gross negligence.

23. Force majeure

The Seller shall not be liable for failure or delay in performing its obligations where this results from events of force majeure or circumstances beyond the Seller’s reasonable control, including natural disasters, floods, fires, strikes, wars, terrorist acts, epidemics, measures by authorities, transport interruptions, customs holds, technical failures, internet outages or third-party service interruptions.

Performance of obligations shall be suspended for the duration of the force majeure event.

24. Links to third-party websites

The website may contain links to third-party websites, platforms or services.

The Seller does not control such websites or services and is not responsible for their contents, terms, policies, products, services or personal data processing.

Access to third-party websites is under the User’s responsibility.

25. Complaints, assistance and alternative dispute resolution

The Seller will review complaints received and respond within a reasonable time.

For disputes with consumers, alternative dispute resolution mechanisms provided by Italian Legislative Decree No. 130/2015 and applicable law may apply.

26. Applicable law and competent court

These Terms and Conditions are governed by Italian law.

For disputes with non-consumer Customers, the court of the place where the Seller has its registered office shall have exclusive jurisdiction, unless another mandatory court is provided by law.

For disputes with Consumer Customers, the competent court shall be the court of the Consumer’s place of residence or domicile, if located in a Member State of the European Union, within the limits provided by applicable law.

The mandatory rights granted to the Consumer by the law of their country of habitual residence, where applicable, remain unaffected.

27. Partial invalidity

If any provision of these Terms is held to be null, invalid or ineffective, such nullity, invalidity or ineffectiveness shall not affect the validity of the remaining provisions, which shall remain fully valid and effective to the extent permitted by law.

28. Language

These Terms may be made available in several languages. In case of interpretative discrepancies between language versions, the Italian version shall prevail, unless mandatory consumer protection rules provide otherwise.
